• You can earn or buy premium currency, but it has no real-world value and is not refundable unless required by law.
• We don't guarantee support, uptime, or access to your account.
• If you break the rules or disrupt the game, we can suspend or delete your account without refund.
• You own your account, but we own the game and everything created inside it — including content you submit.
• We collect your email and date of birth and use Supabase to store data securely. You can delete your account by emailing us.
• If there's a legal dispute, we'll resolve it through individual arbitration, not in court or in a class action.
• Using the game means you agree to these terms.

1. Acceptance of Terms

By creating an account, accessing, or playing Fens (“the Game”), you agree to be bound by these Terms and Conditions. If you do not accept these terms, do not use the Game.

2. Eligibility

You must be at least 18 years old to play. Fens does not knowingly allow minors to access or use the Game. No age verification is in place; if you are a parent or guardian and believe your child is using the Game, please contact us at [email protected].

3. Account Registration

To access Fens, you must create an account using a valid email address and date of birth. You agree to provide accurate information and keep it up to date. You are solely responsible for maintaining the confidentiality of your account.

4. Premium Currency and Payments

Fens may offer a premium in-game currency (“Premium Currency”) which can be obtained via real-money purchases (e.g., PayPal) or earned through in-game activities. Premium Currency:

• May not be gifted
• May be traded for non-premium currency with other players
• Has no real-world cash value
• Is non-refundable except at the sole discretion of Jeremy Scott Clanton or where required by applicable law

All payments are handled by third-party processors. Fens does not store or access payment information.

5. Content Ownership and Licensing

All content submitted, created, or transmitted in-game (e.g., chat messages, usernames, custom names, artwork, game actions, etc.) becomes the sole property of Jeremy Scott Clanton. This includes any AI-generated content used or produced within the Game.

You grant Jeremy Scott Clanton an irrevocable, worldwide, royalty-free license to use, reproduce, distribute, modify, and display any content you create within the Game.

6. Game Behavior and Fair Play

You agree to:

• Use the Game for personal, non-commercial entertainment
• Refrain from exploiting bugs or systems to gain unfair advantage
• Refrain from engaging in conduct that is abusive, disruptive, or unlawful

Specific Rules of Conduct will be published separately and are also binding.

7. Suspension and Termination

We reserve the right to suspend, delete, or modify your account or game data at any time, with or without notice, and without refund, except where prohibited by law.

8. Data and Privacy

Fens collects and stores personally identifiable information (PII), including email and date of birth, using Supabase's built-in authentication and database services. We do not collect or store payment information.

By using Fens, you agree to the collection and use of your data in accordance with our forthcoming Privacy Policy, which will be published at a later date.

9. Account Deletion

You may request account deletion and data removal at any time by emailing [email protected]. Requests will be honored in accordance with applicable privacy laws.

10. Availability and Support

Fens is provided “as is” with no guarantee of availability, performance, or uptime. Support is not guaranteed and may be limited or unavailable.

11. Disclaimers and Limitation of Liability

Use of the Game is at your own risk. Jeremy Scott Clanton disclaims all warranties, express or implied. In no event shall he be liable for any indirect, incidental, or consequential damages, including data loss or interrupted access.

12. Jurisdiction

These Terms are governed by the laws of the State of Nevada, USA. Any disputes shall be subject to the exclusive jurisdiction of the courts of Las Vegas, Nevada.

⚖️ Arbitration Clause

By using Fens, you agree that any dispute, claim, or controversy shall be resolved by binding individual arbitration in Las Vegas, Nevada. You waive any right to a jury trial or class action.

⚠️ Note: This clause may not be enforceable in all jurisdictions. If unenforceable, the remaining Terms shall still apply.

13. Updates to Terms

These Terms may be updated at any time. Continued use of the Game after updates constitutes acceptance of the revised Terms.
